What happened was he claimed the cards were stolen when his car got broken into, then he said he'd buy the spiritmonger and bop for our deal and send them to me, he found a monger but not a bop and I told him to send the monger now and keep on searching for the bop, the last e-mail is the confirmed date of sending...I have more evidence, but it's only of the trade negotiations.

but i got no evidence since it was like 2-3 months ago

Unfortunately, he says he couldn't find my last card (spiritmonger)

I've asked for another bop or $10 USD for compensation.

I mailed him 8 ice age pain lands in July. He claimed they got damaged in the mail. He said he would send his anyway, and I responded by saying I'd resend some painlands based on proof of damaged. I never received his cards or scans of mine being damaged. The moderator suggested he resend, to which he accused me of lying. He then dropped communication.

Other suspicious stuff: asking me to send first because he only simuls +/- 2 refs and not giving me his last name for mailing at first.

I received your package yesterday,  but unfortunately it was just an open
envelope in the mail covred by a plastic wrap saying "postal service
apoligizes blah blah blah" and therewas just teh note (no cards).   I'm not
sure what to do here, so i put it up on the general discussion forum for this

    I went to the post office today with the envelope and i also printed all
of our e-mails.  I showed them to the guy working there and he said hold on.
He came back with the 8 painlands,  2 in a toploader and the other 6 either
bent or ripped.  He said that there's nothing he can do about it, so i took
them and went home.  I also sent your cards out in a bubble mailer to insure
that nothing would happen to your cards.  Please let me know when you recieve. Thanks

"Since you have yet to receive his cards this leaves us with the situation where he would need to send replacements. Under the circumstances the best thing would be to ask him to send your 8 Pain Lands back to you rather than send replacements."

Thanks for the response. I don't believe I've given you any reasons to think I'm a ripper. Check my references, send them emails; I am a completely straight forward trader. Here's why I'm suspicious of your story:

1) You said the first time you sent them it came back with a bad address. I didn't send you a wrong address, so that was either a mistake or a fabrication to buy time.

2) You've never given me any proof that my cards were damaged. By now you could have taken a picture of them and sent it to me.

3) My cards got damaged AND your cards got lost in the mail? That seems a little unlikely to me.

4) You have been very slow to respond to my emails.

5) When we first traded you didn't want to give me your last name.

However, it does speak well of you that you responded to this message, and I didn't make any claims at this point.

SO... Can you show my proof of the damaged cards? Can you show me proof that you sent anything to me? Did you send insured or registered? Is there any new information for this equation?

This still isn't resolved yet. You never responded to my last message, which I thing would be prudent. As Squizz (moderator) said, the best thing at this point is for you to send the 8 pain lands back, damaged or not. I would also take a check for $45, which is fair value of those cards.

That's what it will take that for me to think you aren't a ripper. If I don't get a response from you I am going to go ahead and press charges for mail fraud. I will expect my cards or a check in the mail within ten days, or again I will file mail fraud. I am tired of screwing around, here.

He claims that my cards arrived severely damaged, but has never been able to show proof.

I've already been through a lot of this stuff before and got some help from Squizz, but it never resolved the issue. My last emails to elfarmino never got replies.

I'm 99% convinced I will never see my cards again, so my goal was to add to the evidence that this guy should not be a part of the MOTL community. Unless some new information comes to light, or people actually start getting there cards, my next step will be to file mail fraud and then forget about this whole mess.
